Le rapport de l’IVD sur la répression et la corruption ayant perduré en Tunisie pendant 60 ans, enfin été publié dans le Journal officiel comme l’exige la loi. C’est une marque de reconnaissance très attendue de la nécessité de faire face aux violations des droits humains commises par le passé en vue d’éviter qu’elles ne se répètent à l’avenir.
اتّسم مسار العدالة الانتقالية الذي تقوده هيئة الحقيقة والكرامة منذ عام 2014 بكل شيء ما عدى الاستقرار. فبعد عهدة استمرت لنحو خمس سنوات مضطربة، أنهت الهيئة مهمتها عام 2019؛ إذ أحالت ما لا يقل عن 173 حالة من حالات الانتهاكات الجسيمة لحقوق الإنسان والفساد ونشرت تقريراً شاملا تضمّن النتائج والتوصيات التي خلصت إليها. واليوم نُشِر التقرير في الرائد الرسمي مثلما يقتضي قانون العدالة الانتقالية.
Since 2014, the Transitional Justice process led by Tunisia’s Truth and Dignity Commission (Instance Vérité et Dignité, IVD) has been anything but steady. After a mandate of nearly five tumultuous years, the IVD completed its task in 2019 with the referral to court of at least 173 cases of serious human rights violations and corruption. It also published a comprehensive report including its findings and recommendations. Today, the report was finally published in the Official Gazette as required by Transitional Justice Law.
كان يوم الأربعاء 26 سبتمبر 2018 يوماً مشهوداً في المحكمة الإبتدائية بقفصة، فقد تأججت المشاعر مع دخول نشطاء وقادة انتفاضة الحوض المنجمي -التي اندلعت سنة 2008- إلى قاعة المحكمة نفسها التي تعرضوا فيها للضرب، وحُكِم عليهم فيها بالسجن بصورة جائرة منذ أقل من 10 سنوات مضت. ولكنهم دخلوا هذه المرة عبر الباب الرئيسي كضحايا ينتظرون محاكمة الجناة، لا كمتهمين بالتآمر ضد الدولة. كانت جريمتهم الوحيدة سنة 2008 أنهم تجرّؤوا على الاحتجاج السلمي ضد السياسة التشغيلية غير المنصفة وغياب الشفافية، وضد المحسوبية التي كانت تمارسها شركة فسفاط قفصة المملوكة للدولة، والتي تعتبر المشغل الرئيسي –إن لم يكن الوحيد– في المنطقة.
Le mercredi 26 septembre a été un jour particulièrement important au tribunal de première instance de Gafsa. L’émotion était à son comble quand les militants et les meneurs de la révolte du bassin minier de Gafsa, en 2008, sont entrés dans la salle d’audience où ils avaient été roués de coups, jugés de façon inique et condamnés, il y a presque 10 ans jour pour jour. Mais cette fois, ils sont entrés par la porte principale, en tant que victimes attendant de voir condamnés les auteurs de ces actes, et non en tant que prévenus accusés de comploter contre l’État. Leur seul crime en 2008 ? Avoir osé manifester pacifiquement contre ce qu’ils considéraient comme des pratiques déloyales en matière d’embauche, du népotisme et un manque de transparence de la part de la Compagnie des phosphates de Gafsa, une entreprise détenue par l’État et le principal (voire le seul) employeur de la région.
Wednesday 26 September was a momentous day at the court of First Instance of Gafsa. Emotions ran high as the activists and leaders of the uprising of the Gafsa Mining Basin of 2008 walked into the same court room in which they were beaten up, unfairly tried and sentenced less than 10 years ago. Only this time, they walked in through the main door as victims waiting to see the perpetrators prosecuted- not defendants accused of plotting against the state. Their only crime in 2008? Daring to peacefully protest what they considered to be unfair employment practices, nepotism and lack of transparency by the state-owned Phosphate Company of Gafsa, the region’s main – if not sole – employer.
