قضية الجدة محرزية: من ذكريات ورد أريانة إلى حاضر شوك الإستطباق

في قلب مدينة أريانة، على بعد بضعة أمتار من مقام حارس المدينة سيدي عمار، تقع مجموعة من المنازل بنيت على الطراز القديم: سقيفة وصحن وطابق يسمى “العلي”. بيعت بعض تلك المنازل وتحولت إلى بنايات عصرية بطوابق كثيرة، في حين ما تزال أخرى تقاوم إما السقوط أو مشاريع لتحويلها لعمارات تشبه “طوابع سكر متراصة”. هذا ما يعبر عليه بظاهرة الإستطباق.

Covid-19 in Tunisia: Tensions arise between municipalities and central government

Since the announcement of the first cases of Coronavirus on March 2, 2020, Tunisia’s government has taken measures to slow down the epidemic— the curfew, general confinement and telecommuting for certain sectors. Despite their importance at a national level however, these measures do not call into question the responsibility of local authorities in preserving citizens’ health. A responsibility that follows the principle of administrative freedom stipulated in the Code of Local Collectivities. But to what extent have local authorities fulfilled their role in preventing the spread of the virus? Have conflicts arisen with regards to the government’s prerogatives and the powers conferred on the municipalities?

Dès l’annonce des premiers cas de Coronavirus le 2 mars 2020, le gouvernement a pris des mesures en vue de freiner l’épidémie. Ainsi, l’exécutif a imposé le couvre-feu, le confinement général, et le travail à distance dans certains secteurs. Cependant, malgré leur importance au niveau national, ces mesures ne remettent pas en cause la responsabilité des autorités locales dans la préservation de la santé des citoyens, conformément au principe de libre administration, tel que stipulé dans le Code des collectivités locales. Mais dans quelle mesure l’autorité locale a-t-elle joué son rôle dans la prévention de la propagation du virus? Des différends auraient-ils émergé concernant les prérogatives de l’autorité centrale et les compétences conférées aux municipalités?

في زمن كورونا: صراع التموقع بين السلطة المركزية والسلطة المحلّية في تونس

منذ الإعلان عن أولى الإصابات بفيروس كورونا بتاريخ 2 مارس 2020، اتّخذت السلطة التنفيذيّة قرارات وقائيّة لاحتواء الفيروس والحدّ من انتشاره، من ذلك مثلا فرض حظر التجوّل والحجر الصحّي الشّامل وإقرار العمل عن بُعد في عدد من القطاعات. ورغم أهميّة هذه الإجراءات في بُعدها الوطني، إلا أنّها لا تنفي مسؤوليّة السلطة المحلّية في دعم هذه التدابير وحماية صحّة مواطنيها تكريسا لمبدأ التدبير الحرّ المنصوص عليه بمجلّة الجماعات المحلّية. فإلى أيّ مدى اضطلعت السّلطة المحليّة بدورها في التوقّي من انتشار الفيروس؟ وهل حصل تنازع بين صلاحيات السلطة المركزية والبلديات؟

منظومة التوافق تجهض إغلاق ملفّ المحكمة الدستورية

بانتظار يوم الأربعاء المقبل، كموعد جديد لعقد جلسة عامّة ثالثة لانتخاب أعضاء المحكمة الدستوريّة، يظلّ هذا الملّف مفتوحا على جولات أخرى من التأجيل، بعد فشل الجلسة العامة لمجلس نواب الشعب يوم الأربعاء 14 مارس الجاري، في إيجاد حدّ أدنى من التوافق بين مختلف الأطياف السياسيّة. منظومة التوافقات التّي تحوّلت إلى الآليّة الرئيسيّة في تسيير الشأن السياسي منذ سنة 2014، مثّلت العائق الأبرز لتركيز هذه الهيئة القضائية المستقلة ضمن مسار متعثّر لإنهاء الأحكام الانتقاليّة وتفعيل دستور 27 جانفي 2014 بشكل كامل.

Constitutional Court: consensus blocked it, consensus to move it forward

In parliament this week, deputies fixed the date on which they will elect the first four members of Tunisia’s Constitutional Court. Long held up in the selection process, the assembly now has less than a month to approve candidates before voting on March 13, 2018. Four years after the adoption of a new Constitution and three years after passing the organic law concerning the Constitutional Court, deputies have been under mounting pressure to establish the unique authority with the capacity to ensure the constitutionality of the laws. Consensus is at once the main cause of delays and also the solution of last recourse. At this late phase, will it enable them to move forward?

حوار مع فاضل موسى: ”الشروط الإقصائية وراء تأخير إرساء المحكمة الدستورية“

بمناسبة الذكرى الرابعة لدستور جانفي 2014، توقّف أستاذ القانون والنائب المؤسس فاضل موسى في حوار أجراه مع نواة على أسباب التأخير الذي عرفه إرساء المحكمة الدستورية، راجعا إلى بعض الشروط التي تمّ التنصيص عليها لعضوية المحكمة وواصفا إياها بالإقصائية. في المقابل، أثار فاضل موسى الانعاكاسات الخطيرة التي يمكن أن تنجرّ عن عدم وجود المحكمة الدستورية وكذلك بعض الهنات في عمل الهيئة الوقتية لمراقبة دستورية القوانين والتي لم يتداركها القانون الأساسي المصادق عليه في 03 ديسمبر 2015 .

Armoiries de la 2ème République : A la recherche de la « dignité »

On aura beau chercher, sur les formulaires, les extraits de naissance ou de mariage, sur les cartes d’identité ou les passeports, impossible de dénicher le mot « dignité » sur un document officiel tunisien. Alors que la devise nationale a été modifiée dans l’Article 4 de la constitution, pour ajouter le mot « dignité », passant ainsi de « Liberté, Justice, Ordre » à « Liberté, Dignité, Justice, Ordre », les armoiries, elles, n’ont pas suivi. Quatre ans après la nouvelle constitution, nous sommes partis à la recherche de la « dignité ».

“Ce projet de constitution est un hold-up de la révolution”, Ces mots lancés par la députée Karima Souid quelques jours avant la diffusion du brouillon de la constitution annonce un projet qui ne fait pas consensus au sein des députés. C’est pourtant bien la version qui a circulé sur internet avant même d’être soumise aux députés, qui sera étudiée par le comité mixte de coordination cette semaine.
